By placing an order with Ares Custom Rifles LLC you agree to the following terms. These terms incorporate applicable federal law — including the Gun Control Act of 1968 (GCA), the National Firearms Act (NFA), and regulations issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) — as well as the laws of the State of MO.
1. Purchaser Eligibility
You must meet all of the following requirements to purchase a firearm from this website:
- You must be at least 18 years of age to purchase long guns (rifles and shotguns).
- You must be at least 21 years of age to purchase handguns or handgun-only ammunition.
- You must not be a prohibited person under 18 U.S.C. § 922(g), including but not limited to: convicted felons; persons convicted of a misdemeanor crime of domestic violence; persons subject to certain restraining orders; fugitives from justice; unlawful users of controlled substances; persons adjudicated as a mental defective or committed to a mental institution; illegal aliens; persons who have renounced U.S. citizenship; and persons dishonorably discharged from the military.
- The firearm must be legal to possess in your state and locality.
- You must be a U.S. resident. We do not ship internationally.
By placing an order you certify under penalty of law that you meet all applicable eligibility requirements. False statements in connection with the acquisition of a firearm are a federal felony under 18 U.S.C. § 922(a)(6).
2. FFL Transfer Requirement
Federal law requires that all Title I firearms (handguns, rifles, shotguns, and most other firearms) be transferred through a licensed Federal Firearms Licensee (FFL dealer). We do not ship firearms directly to customers. You must:
- Identify a licensed FFL dealer in your area who will accept the transfer.
- Provide the dealer's complete information (name, address, FFL number, phone, and email) at checkout.
- Contact the dealer in advance to confirm they will accept transfers and their fee.
- Present valid government-issued photo ID to the dealer when picking up the firearm.
- Complete ATF Form 4473 (Firearms Transaction Record) at the dealer's location.
- Pass a NICS (National Instant Criminal Background Check System) background check.
The firearm will be shipped to the FFL dealer's licensed premises. You must pick up the firearm in your state of residence. Interstate firearm transfers to non-licensed individuals are only legal between FFLs. We will verify the receiving dealer's FFL license before shipping.
3. Background Checks
All firearm transfers require a NICS background check conducted by the receiving FFL dealer. The check is initiated when you complete Form 4473. Possible outcomes:
- Proceed: Transfer may complete immediately.
- Delayed: The dealer must wait up to 3 business days. If no response is received after 3 business days the dealer may (but is not required to) transfer the firearm at their discretion.
- Denied: The transfer cannot proceed. The firearm will be returned to us. NICS denial refunds are issued for the purchase price of the firearm minus a $50 processing and restocking fee. Original shipping charges are non-refundable.
We are not responsible for delays or denials. If you believe you were incorrectly denied you may appeal through the FBI's NICS Section.
4. NFA Items (Suppressors, SBRs, SBSs, Machine Guns, AOWs)
Items regulated under the National Firearms Act require additional steps before transfer:
- NFA items may only be transferred through a licensed Class III SOT (Special Occupational Taxpayer) dealer.
- You must submit ATF Form 4 (or Form 1 for items you manufacture) along with a $200 tax stamp payment to the ATF.
- Individual buyers must submit two sets of fingerprints, two passport photos, and notify their Chief Law Enforcement Officer (CLEO).
- Current ATF processing times for Form 4 are typically 8–14 months. We will hold the item until your approved Form 4 is returned.
- NFA items are prohibited in some states. It is your responsibility to confirm the item is legal in your state before ordering. We will not ship NFA items to California, Delaware, Hawaii, Illinois, Iowa, Massachusetts, Minnesota, Nevada, New Jersey, New York, North Dakota, Rhode Island, Washington, or any other state that prohibits civilian ownership.
5. MO State Law
Ares Custom Rifles LLC is a Missouri-based FFL dealer. Missouri state law relevant to firearm purchases:
- No permit required to purchase rifles, shotguns, or handguns.
- No firearm registration required.
- No waiting period under Missouri state law (federal law and NICS check still apply).
- Missouri is a permitless carry state (constitutional carry) for residents 19 and older who may lawfully possess a firearm.
- Missouri has no state-level assault weapon ban or magazine capacity restrictions.
Federal law applies in all cases regardless of state law. Missouri residents purchasing from us are still subject to the federal GCA and NFA.
6. Custom Builds
Custom firearm builds are made to order. By submitting a build quote and paying a deposit you agree to the following:
- A 50% deposit is required to begin your build. The balance is due upon completion before shipment.
- Deposits are non-refundable once parts have been ordered. If we cancel your order before parts are ordered, your deposit is fully refunded.
- Lead times are estimates only. Current lead time is approximately 12 weeks. Complex builds or custom finishes may take longer.
- All custom builds are test-fired before delivery. We stand behind our workmanship.
- You are responsible for ensuring that the configuration you specify is legal in your state.
7. Payment
All prices are in U.S. dollars. Payment is processed through Fortis, a firearms-friendly payment processor. We reserve the right to correct pricing errors prior to shipment. For custom builds, a 50% deposit is charged at the time you approve the build quote; the balance is due upon completion.
8. Order Cancellation
We reserve the right to cancel any order at our discretion, including for suspected fraud, legal concerns, inaccurate information, or stock availability. If we cancel your order you will receive a full refund. If you cancel a standard product order before it ships, you will receive a full refund. Custom build deposit cancellation terms are described in Section 6 above.
9. ATF Record-Keeping
As a federally licensed firearms dealer, Ares Custom Rifles LLC is required by federal law (27 CFR Part 478) to maintain Acquisition and Disposition (A&D) records and retain copies of ATF Form 4473 for a minimum of 20 years. These records may not be destroyed and are subject to ATF inspection. Our bound book (A&D record) is maintained for the lifetime of our license plus 20 years and is transferred to the ATF upon cessation of business. These legal obligations supersede any personal data deletion requests with respect to federally mandated firearm transaction records.
10. Limitation of Liability
Ares Custom Rifles LLC is not liable for any injury, damage, or loss resulting from the use or misuse of any firearm, part, or accessory purchased from this site. All products must be used in accordance with applicable law and safe firearms handling practices. Our liability to you for any claim arising out of a purchase is limited to the amount you paid for the item.
11. Governing Law
These terms are governed by the laws of the State of MO and applicable federal law. Any disputes arising under these terms shall be resolved in the state or federal courts located in MO, and you consent to personal jurisdiction in those courts.
12. Changes to These Terms
We reserve the right to update these terms at any time. Changes are effective upon posting. Continued use of our site constitutes acceptance of any updated terms.
